Divorce Cases: While every case is different, most couples must address the issues of asset division and alimony (now known as “maintenance”) in the divorce process. Illinois law encourages couples to agree, but courts will turn to the divorce statute where compromise on marital property distribution is not possible.

The objective of spousal support, commonly termed alimony, is to fairly balance one spouse’s need and the other’s income. Where one party sacrificed opportunities to contribute to the marital household, a judge may order reasonable alimony.

Custody and Support of Minor Children: Illinois no longer refers to the traditional notions of custody and visitation, having enacted a statute on Allocation of Parental Responsibilities and parenting time. This approach enables both parents to participate in raising the child and maintain strong, healthy relationships. Still, the law requires consideration of the child’s best interests for decisions on education, religion, extracurricular activities, and medical care.

Regardless of marriage, parents have a legal obligation to support their children financially. A noncustodial parent is generally ordered to pay child support, and the amount is determined by statutory formulas and other factors. A child support order may be subject to modification based upon a change in circumstances.
