Orland Park Family Law Attorney

Many people assume the only reason to hire an Orland Park family law attorney is for a divorce. However, family law encompasses much more than just a divorce, including child custody modifications, domestic violence, post-divorce judgment enforcement, spousal support modifications, and more. To learn more about how an attorney can help with all your legal needs, contact the Orland Park family law attorneys at Law Office of Demetrios N Dalmares and Associates Ltd..

Modify Pre-Existing Family Law Court Orders

When a family court judge issues an order, parties are obligated to abide by it. However, courts also recognize that circumstances can change. Therefore, some situations will make it necessary to modify an existing court order. Getting the court to hear your request for modification is not always easy. The process can be complicated, especially because Illinois has strict guidelines on what qualifies for modifications. For example, Illinois courts will only agree to modify a child support case if the person applying for the change can prove they have undergone a significant change in circumstances.

If the request for modification is in your child’s best interests, it may be easier to get it approved. Courts look at what is in your child’s best interests but also that:

  • The requested modification reflects the actual arrangement of what has been going on for the past six months, and the child was receiving care without objection from the other parent;
  • The requested change is necessary to change an agreed-upon parenting plan that the court would have never approved if it had been aware of the circumstances;
  • The requested change is minor; or
  • Both parties are in agreement with the requested modifications.

Do not try to handle a modification to a family law order on your own. Instead, contact our experienced legal team for help navigating all the legal challenges.

Domestic Violence Assistance

Our Orland Park family law attorneys can help with some domestic violence matters, as well. This is applicable even when the domestic violence allegations are not combined with a divorce proceeding. If you are alleging domestic abuse and requesting an Order of Protection, we may be able to help get your request approved. A family court judge in Illinois could take any of the following steps:

  • Limiting parental rights;
  • Prohibiting someone from entering the residence you share with them;
  • Preventing someone from relocating out of state with a child;
  • Banning someone from going to your home or place of employment;
  • Requiring someone to attend counseling; or
  • Require that someone to turn over all firearms they have in their possession.

To understand what rights you might have under an Order of Protection, contact our office today to schedule a consultation.

Filing for Divorce

If you are planning to file for divorce in Illinois, you must meet the residency requirements of living in the state for the last 90 days and show irreconcilable differences. We can help you resolve all outstanding issues like child support, alimony, parenting time and responsibility, property settlement, etc.
